မြန်မာနိုင်ငံမှာ မူပိုင်ခွင့်ဥပဒေ (၄) ရပ်ဖြစ်တဲ့ ကုန်အမှတ်တံဆိပ်မူပိုင်ခွင့်ဥပဒေ၊ စက်မှုဒီဇိုင်းမူပိုင်ခွင့် ဥပဒေ၊ စာပေနှင့်အနုပညာ မူပိုင်ခွင့်ဥပဒေနဲ့ တီထွင်မှုမူပိုင်ခွင့်ဥပဒေတွေကို ၂၀၁၉ ခုနှစ်က အတည်ပြု ပြဋ္ဌာန်းခဲ့ပါတယ်။ လက်ရှိအချိန်မှာတော့ မူပိုင်ခွင့်ဥပဒေ (၄) ရပ်အတွက် လိုအပ်တဲ့ နည်းဥပဒေတွေကို ရေးဆွဲပြီး အတည်ပြုနိုင်ရေးအတွက် ဆောင်ရွက်လျက်ရှိပါတယ်။ မူပိုင်ခွင့်ဥပဒေ (၄) ရပ်အနက် ကုန်အမှတ် တံဆိပ်မူပိုင်ခွင့်ဥပဒေကို ၂၀၂၃ ခုနှစ်၊ ဧပြီလ ၁ ရက်နေ့တွင်လည်းကောင်း၊ စက်မှုဒီဇိုင်းမူပိုင်ခွင့်ဥပဒေ နှင့် စာပေနှင့်အနုပညာမူပိုင်ခွင့်ဥပဒေတို့ကို ၂၀၂၃ ခုနှစ်၊ အောက်တိုဘာလ ၃၁ ရက်နေ့တွင် လည်းကောင်း အာဏာတည်ခဲ့ပြီးဖြစ်ပါတယ်။ တီထွင်မှုမူပိုင်ခွင့်ဥပဒေကို ၂၀၂၄ ခုနှစ်၊ ပထမသုံးလပတ် တွင် အာဏာတည်နိုင်ရေး လုပ်ထုံးလုပ်နည်း နှင့်အညီ ဆောင်ရွက်လျက်ရှိပါတယ်။
၂၀၁၉ ခုနှစ်က ပြဋ္ဌာန်းခဲ့တဲ့ မူပိုင်ခွင့်ဥပဒေ (၄) ရပ်ဖြစ်တဲ့ ကုန်အမှတ်တံဆိပ်မူပိုင်ခွင့်ဥပဒေ၊ စက်မှု ဒီဇိုင်းမူပိုင်ခွင့်ဥပဒေ၊ စာပေနှင့်အနုပညာမူပိုင်ခွင့်ဥပဒေနဲ့ တီထွင်မှုမူပိုင်ခွင့်ဥပဒေများကို အကောင် အထည်ဖော်ရန် အမှတ်တံဆိပ်မှတ်ပုံတင်ခြင်းဆိုင်ရာနည်းဥပဒေ၊ စာပေနှင့်အနုပညာမူပိုင်ခွင့်ဆိုင်ရာ လက်ရာများ သို့မဟုတ် ဆက်နွှယ်သည့် အခွင့်အရေးဆိုင်ရာကိစ္စရပ်များကို မှတ်ပုံတင်ခြင်းဆိုင်ရာ နည်းဥပဒေများ၊ စက်မှုဒီဇိုင်းမှတ်ပုံတင်ခြင်းဆိုင်ရာနည်းဥပဒေများကို ထုတ်ပြန်ပြီးဖြစ်ပါတယ်။ တီထွင်မှုမူပိုင်ခွင့်နည်းဥပဒေကိုထုတ်ပြန်နိုင်ရေးလုပ်ထုံးလုပ်နည်းနှင့်အညီဆောင်ရွက်လျက်ရှိပါတယ်။

The appearance of the industrial or handicraft product, parts of the product, get-up, packaging, typographic typefaces, graphic symbols can be filed as an Industrial Design.
The applicant needs to make the priority claim when filing the application (ID -1). Priority date should be claimed within 6 months from the earlier filing.
The applicant needs to make the request for deferment of publication and fill out the deferment period in the application form (ID -1) when filing the application.
The Intellectual Property Department will verify industrial design applications and notify the applicant or representative to correct the application within 30 days. For the incorrect class indicated on the application, there is no need to pay the fee.
The term of the registered industrial design is given 5 years from the filing date of the registration of industrial design and may be renewal, for not more than two consecutive periods of five years each.
The industrial design representation shall be submitted in the form of drawings, photographs or other graphic representations. The two-dimensional industrial design may be represented by one view that fully discloses the industrial design or the three-dimensional industrial design by several different views that fully disclose the industrial design. The several different views may contain up to front, back, left, right, top, bottom and perspective views of entire industrial design.
The applicant needs to file the application with industrial design application form (ID -1). In the application, the applicant must fill out (i) Name and address of the applicant or legal entity; (ii) Name, citizenship scrutiny card number, address of the representative where the application is filed by the representative and Appointment of representative (ID -2); (iii) A sufficiently clear representation of the industrial design; (vi) Indication of the products to which the industrial design is applied or embodied; (v) Payment receipt; (vi) Statement of justifying applicant’s right should be filed the industrial design application form (ID-1a) if the applicant is not the creator; and (vii) Other requirement.

ကုန်အမှတ်တံဆိပ်မူပိုင်ခွင့်ဥပဒပုဒ်မ ၉၃၊ ပုဒ်မခွဲ (က) ပါ စာချုပ်စာတမ်းများ မှတ်ပုံ တင်ရုံးတွင် မှတ်ပုံတင်ထားသည့် အမှတ်တံဆိပ်ပိုင်ရှင် သို့မဟုတ် မှတ်ပုံမတင် ထားသော် လည်း နိုင်ငံတော်၏ဈေးကွက်အတွင်းတွင် အမှန်တကယ်အသုံးပြုနေသော အမှတ်တံဆိပ် ပိုင်ရှင်များ သည် စီးပွားရေးနှင့်ကူးသန်းရောင်းဝယ်ရေးဝန်ကြီးဌာန၏ အမိန့် (၆၃/၂၀၂၀)၊ အပိုဒ် (၁) အရ လျှောက်ထားနိုင်သည်။
မှတ်ပုံတင်လျှောက်ထားရာတွင် အမိန့် (၆၃/၂၀၂၀) ၏ အပိုဒ် (၃) အရ ပထမအဆင့် အနေဖြင့် လျှောက်ထားခြင်းကို ဝန်ဆောင်မှုအဖြစ် ဆောင်ရွက်နေသော လုပ်ငန်း၊ ကုမ္ပဏီ နှင့် ဥပဒေအကျိုးဆောင်အဖွဲ့များမှတစ်ဆင့် (WIPO File- Online IP filing System) ဖြင့် လျှောက် ထားခွင့်ပြုမည်ဖြစ်ပြီး ဒုတိယအဆင့်တွင် လူကိုယ်တိုင် မူပိုင်ခွင့်ဌာနသို့ တိုက်ရိုက် ဖြစ်စေ၊ ပထမအဆင့်တွင် လျှောက်ထားခွင့်ရသူများမှ တစ်ဆင့်ဖြစ်စေ လျှောက်ထားခွင့်ပြု မည်ဖြစ်ပြီး ဒုတိယအဆင့်အား စတင်ဆောင်ရွက်မည့် နေ့ရက်ကို ထပ်မံ ကြေညာသွားမည် ဖြစ်ပါသည်။ ယင်းသို့အဆင့်(၂)ဆင့်ဖြင့် ခွဲခြားလျှောက်ထားရသော်လည်း ဥပဒေပုဒ်မ ၉၃၊ ပုဒ်မခွဲ (ခ) အရ အသုံးပြုခြင်းဆိုင်ရာ ဦးစားပေးအခွင့်အရေးနှင့် လျှောက်ထားချက်ပါ လိုအပ် သည့် အခြေခံ အချက်အလက်များ ပြည့်စုံလျှင်လျှောက်ထားချက် တင်သွင်းသည့်နေ့အား တန်းတူအခွင့် အရေးရရှိမည် ဖြစ်ပါသည်။
စီးပွားရေးနှင့်ကူးသန်းရောင်းဝယ်ရေးဝန်ကြီးဌာန၏ အမိန့်(၆၃/၂၀၂၀)အရ လျှောက်ထား ရာတွင် အမိန့် (၆၃/၂၀၂၀)၏ အပိုဒ် (၇)၊ (က) မှ (ဆ) အထိ သက်သေခံ အထောက် အထားများ အပြင် (ဇ) အရ အမှတ်တံဆိပ်အသုံးပြုခြင်းနှင့် သက်ဆိုင်သည့် အခြားမည်သည့် အထောက် အထားကိုမဆို တင်ပြနိုင်သည်။
အမိန့်(၆၃/၂၀၂၀) ၏ အပိုဒ် (၆) အရ ကုန်အမှတ်တံဆိပ်မှတ်ပုံတင်ရန်အတွက် အခကြေးငွေနှင့် ပေးဆောင်ရမည့်နည်းလမ်းများကို သီးခြားထုတ်ပြန်ကြေညာသွားမည် ဖြစ် ပါသည်။
လျှောက်ထားခြင်းကို ဝန်ဆောင်မှုအဖြစ်ဆောင်ရွက်နေသောလုပ်ငန်း၊ ကုမ္ပဏီနှင့် ဥပဒေ အကျိုးဆောင်အဖွဲ့များအတွက် WIPO File Account လျှောက်ထားခြင်းအား သတင်းစာမှ တဆင့် အသိပေးကြေညာခြင်း ပြုလုပ်သွားမည်ဖြစ်ပါသည်။

ကုန်အမှတ်တံဆိပ်ကို လျှောက်ထားရာတွင် ကိုယ်စားလှယ်ခန့်အပ်ခြင်းအတွက် Power of Attorney (POA) လုံးဝမလိုအပ်ပါ။ Soft Opening ကာလအတွင်း ပထမအဆင့် အနေဖြင့် online filing ဖြင့် အမှတ်တံဆိပ်များကို လျှောက်ထားရာ၌ ကိုယ်စားလှယ်နှင့် စပ်လျဉ်းသည့် အချက်များကို ဖြည့်စွက် ရမည်ဖြစ်သော်လည်း ကိုယ်စားလှယ်ခန့်အပ်လွှာကို ပူးတွဲတင်ပြရန် မလိုအပ်သေးပါ။ ကိုယ်စားလှယ်ခန့်အပ်လွှာ တင်ပြရမည့်အချိန်အား ထပ်မံအသိပေးအကြောင်း ကြားမည်ဖြစ်သည်။ အမှတ်တံဆိပ် လျှောက်ထားချက် တစ်ခုချင်းစီ အတွက် ကိုယ်စားလှယ် ခန့်အပ်လွှာ တစ်စောင်စီ ပါရှိရမည် ဖြစ်သည်။
အမိန့် (၆၃/၂၀၂၀) ၏ အပိုဒ် (၂) အရ Online Filing ဖြင့် လျှောက်ထားခြင်းအား ၂၀၂၀ ပြည့်နှစ်၊ အောက်တိုဘာလ ၁ ရက်နေ့တွင် စတင်အသုံးပြုနိုင်မည်ဖြစ်သည်။
ကုန်အမှတ်တံဆိပ်လျှောက်လွှာတစ်စောင်တွင် ကုန်ပစ္စည်းနှင့် ဝန်ဆောင်မှု အမျိုး အစား တစ်ခုထက်ပို၍ လျှောက်ထားနိုင်မည် ဖြစ်သည်။ ဆိုလိုသည်မှာ လျှောက်လွှာတစ်ခုတွင် multiple classes လျှောက်ထားနိုင်ပါသည်။
မှတ်ပုံတင်ရန်လျှောက်ထားသော အမှတ်တံဆိပ်သည် စာချုပ်စာတမ်းများ မှတ်ပုံတင် ရုံးတွင် မှတ်ပုံတင်ထားသည့် အမှတ်တံဆိပ် သို့မဟုတ် မှတ်ပုံ မတင်ထားသော်လည်း နိုင်ငံတော်၏ဈေးကွက်အတွင်းတွင် အမှန်တကယ်အသုံးပြုနေသော အမှတ်တံဆိပ်နှင့် ထပ်တူ ညီရမည် ဖြစ်ပြီး ကုန်ပစ္စည်းနှင့်ဝန်ဆောင်မှု အမျိုးအစားများလည်း ထပ်တူညီ ရမည် ဖြစ်ပါသည်။
